説明Two movie posters side by side at a Cinemark near Cleveland, Ohio.Welcome to the wacky world of copyright.Action Comics (the antecedent of DC Comics) began publishing Superman on April 18, 1938.Fawcett Publications created Captain Marvel in December 1939. DC Comics sued for copyright violation in 1941. The case, which was decided, appealed, retried, and so on, lasted until 1952. Fawcett finally settled out of court in 1953, paying DC Comics $400,000 ($3.8 million in 208 dollars) in damages and agreeing to cease publishing Captain Marvel comic books forever. (The last court decision held that Marvel had infringed on a number of stories and indicia which first appeared in Superman comics, although the character of Captain Marvel himself did not.)In 1961, Atlas Comics/Timely Comics changed their name to Marvel Comics. In December 1967, Fawcett failed to renew its copyright to Captain Marvel. At the time, copyright lasted just 28 years, unless renewed. Renewal was not automatic. Marvel Comics created their own Captain Marvel (Mar-Vell), and trademarked the name the same month.DC Comics licensed Captain Marvel and all indicia and characters from Fawcett in 1972. Marvel Comics issued a cease-and-desist letter to DC Comics, claiming they had the trademark to the Captain Marvel name. DC Comics had to stop referring to their character as Captain Marvel on the cover of comics, although they could continue to refer to "Captain Marvel" in the interiors (as some Captain Marvel stories had not lost copyright, and DC Comics had licensed those characters).DC now began referring to their character as Shazam. Other characters, like Mary Marvel and Captain Marvel, Jr. could be used on covers since their copyrights had not expired.In 1991, DC purchased the entire Marvel Family and related characters and indicia outright from Fawcett.Captain Marvel never was popular for Marvel Comics. The company, however, must publish a "Captain Marvel" comic book at least once every two years in order to keep the trademark active.
